CINCINNATI - When Ohio Democrats challenged the
Republican secretary of state on how county elections boards should handle
provisional ballots, the courts were thrust into a heated political
dispute.Within weeks, a federal judge appointed by former President Clinton
upheld the Democrats' argument. Secretary of State Kenneth Blackwell appealed. A
federal appeals court panel of two Republican appointees and one Democrat
reversed the lower court decision and ruled in his favor.
